Introduction
Prankcast is a media broadcasting platform ("the Platform"), accessible at https://prankcast.com, and owned and operated by Bored Katz LLC (“the Company”), a company registered in Wyoming and operating out of New York. The Company values user privacy and is committed to protecting your personal information. This Privacy Policy explains how the Company collects, uses, stores, and shares your personal data when you access or use Platform.

By accessing or using the Platform, you agree to the practices outlined in this Privacy Policy (“Privacy Policy”). If you do not agree, please refrain from using the Platform.

1. Definitions

   1. “Content”: Any media (text, photos, audio, or video) uploaded, streamed, or otherwise made accessible on the Platform.
   2. “Users”: Users who register accounts on the Platform, for purposes of: broadcasting live shows, uploading Content to the Platform; accessing Content streamed or uploaded to the Platform; or using Platform features like chat rooms, sound boards, and any other provided features.
   3. “Operation”: The activities directly required to host, maintain, improve, and provide the Platform’s features and services to its Users. This includes, but is not limited to, storing, streaming, and displaying Content, ensuring technical functionality, implementing updates, and facilitating user interactions within the Platform.
   4. “Support Email”: legal@prankcast.com.

2. Information the Company Collects
   The Company may collect the following types of information when you use the Platform:

   1. Personal Information: Information you provide to the Company when registering for an account, including your email address, avatar picture, and other contact details.
   2. Usage Information: Information about your use of the Platform, including preferences, settings, and activity history (e.g., Content you’ve uploaded or streamed, and your interactions with other Users).
   3. Browser Information: Information about your device, IP address, browser type, and other technical data to improve your experience with the Platform. This may include usage logs, cookies, and other tracking technologies solely used in connection with improving your experience.
   4. Communications: Any communication between you and the Company, including customer service interactions, inquiries, and feedback.
   5. Payment Information: If you subscribe to any paid services, the Company may collect payment details such as transaction-related data. Credit-card information is collected for secure payment processing by third-party payment processors.

3. How the Company Uses Your Information
   The Company may use the information it collects for the following purposes:

   1. Provide the Platform: To enable your use of the Platform, including creating and managing your account, uploading Content, streaming, interacting with other Users, and accessing features like chat rooms.
   2. Improve User Experience: To customize the Platform experience for you, enhance functionality, and troubleshoot issues.
   3. Communication: To send you notifications, updates, and information regarding your account, including platform updates, promotional offers (if applicable), and other communications relevant to your use of the Platform.
   4. Transaction Processing: To process payments for paid memberships or other premium services, and manage your subscription or payment history.
   5. Legal Compliance: To comply with applicable laws, regulations, or legal processes, including protecting the rights of the Company, responding to legal requests, and investigating potential violations of the Terms of Service.
   6. Marketing and Promotions: To send you configurable notifications about your account and other Users you follow on the Platform, or occasional marketing materials / promotional offers related to the Platform, if you have opted in to receive such communications.

4. Sharing Your Information
   The Company will never sell your personal information to third parties. However, the Company may share your information under the following circumstances:

   1. Service Providers: The Company may share your information with trusted third-party service providers who assist the Company in operating the Platform, processing payments, providing customer support, and conducting marketing activities. These service providers are required to use your information only to perform the services the Company requests and are bound by confidentiality agreements. You can see a full breakdown of these providers and what access they have in Exhibit A.
   2. Legal Requirements: The Company may disclose your information if required by law, such as in response to a court order, subpoena, or legal process, or to protect the rights, property, or safety of the Company, Users of the Platform, or others.
      Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of the Company assets, your personal information may be transferred as part of that transaction for the purposes of continued Operations under new ownership. The Company will notify you of such a change and update the Company Privacy Policy accordingly.

5. Data Security
   The Company takes reasonable measures to protect your personal information from unauthorized access, use, or disclosure. However, no security system is perfect, and the Company cannot guarantee the absolute security of your information. It is important that you take steps to protect your account, including choosing a strong password and logging out after using the Platform. Never share credentials or account login information with other people.

6. Your Rights and Choices
   You have certain rights regarding your personal information:

   1. Access and Update: You can access and update your account information at any time by logging into your account on the Platform.
   2. Opt-out of Marketing Communications: You can opt out of receiving promotional emails or other marketing communications by following the notification preference instructions linked in every email or contacting the Company directly.
   3. Data Deletion: You may request that the Company deletes your personal information from the Company records, subject to certain legal obligations and exceptions. If you wish to delete your account, please contact the Company at the Support Email.

If you delete your account, the Company will delete your personal contact information, but may retain certain information (eg. traffic logs) for backup, archival, or legal purposes, as permitted by law.

   The Platform is not intended for Users under the age of 18, and the Company does not knowingly collect personal information from Users under 18. If the Company becomes aware that it has collected personal information from a User under 18, the Company will take steps to delete such information.

   The Company uses cookies and other short-term tracking technologies to improve your experience on the Platform itself. These technologies allow the Platform to more easily store and process certain information, such as your display preferences, and monitor usage patterns to provide a more personalized experience. You can control the use of cookies through your browser settings, but disabling cookies may affect the functionality of the Platform, including the ability to log in.

10. Reasonable Expectation of Privacy
    The Company respects your privacy, and will never share, sell, or resell your personal information to third parties, except as outlined in this Privacy Policy or as required by law. However, the Company cannot guarantee absolute privacy, as no service can ensure complete security. By using the Platform, you understand and acknowledge that your information may be processed as described in this Privacy Policy.

11. Changes to This Privacy Policy
    The Company may update this Privacy Policy from time to time. When this document is updated, the Company will post the updated policy on the Platform with the updated “Effective Date.” Your continued use of the Platform after the changes are posted constitutes your acceptance of the revised policy.
